These Terms & Conditions govern your engagement with Etibahn, a trusted B2B manufacturer and supplier of bulk packaging solutions. By placing an order with us, clients acknowledge and agree to the terms outlined below.
Quotations & Orders
In the course of our business operations, we may collect the following types of information:
All quotations provided by Etibahn are valid for a limited period (X days) from the date of issue, unless otherwise specified in writing.
Orders are considered confirmed only upon receipt of advance payment or full payment as mutually agreed with the client.
Any change in order specifications after confirmation may affect lead times, pricing, or delivery schedules.
Production & Delivery
Production lead times depend on product category, customization requirements (such as printing, branding, or finishing), and overall order volume.
While we strive to meet all delivery commitments, delays caused by force majeure events, raw material shortages, transportation strikes, port congestion, or other unforeseen logistics disruptions may occur.
Clients will be promptly informed of any such delays, and Etibahn will make every reasonable effort to minimize the impact.
Pricing & Payment Terms
Unless otherwise stated, all prices quoted are exclusive of GST, duties, taxes, and freight charges.
For export shipments, pricing and cost responsibilities are defined as per mutually agreed Incoterms (FOB, CIF, DDP, etc).
Payment terms are governed by the contract or invoice issued at the time of order confirmation.
Intellectual Property Rights
Any logos, artworks, brand elements, or proprietary designs shared by clients remain their intellectual property.
Etibahn will use these materials solely for the purpose of manufacturing the ordered products.
We do not claim ownership over client IP and ensure that all creative assets are handled with strict confidentiality.
Limitation of Liability
Etibahn’s liability is limited to the value of the goods supplied under the order.
We are not responsible for any indirect, incidental, or consequential damages, including but not limited to business losses, loss of profits, or delays caused by external factors.
In case of disputes, the client’s sole remedy shall be limited to replacement, adjustment, or refund as per our agreed policies.
Governing Law & Jurisdiction
All contracts and agreements with Etibahn are governed by the laws of India.
Any disputes arising out of or relating to these Terms & Conditions shall fall under the exclusive jurisdiction of Delhi, NCR courts.
